  7.                  THE PIER EXCHANGE LICENSE AGREEMENT

  9. This License Agreement is your Proof of License.
  10.  
  11. This is a legal agreement between you (either an individual or entity),
  12. the end user and The Pier Exchange. If you do not agree to the terms of
  13. this Agreement, promptly return the CD-ROM disk package and accompanying
  14. items to the Dealer you obtained it for a full refund.

  16. THE PIER SHAREWARE CD-ROM LICENSE
  17.  
  18. 1.  Copyright and Grant of License:
  19.  
  20. The Pier Shareware CD-ROM is copyrighted. The Pier Exchange retains
  21. ownership of the enclosed CD-ROM. The Pier Shareware CD-ROM is Licensed
  22. to you for use as permitted by this Agreement.

  24. 2.  Permitted Use:
  25.  
  26. You may use The Pier CD-ROM on compatible computer including networks.
  27. You may use The Pier CD-ROM on public or private Bulletin Board Systems.
  28. You may use all of the programs provided on the CD-ROM in accordance
  29. with the terms of the Authors of the programs in question. The files
  30. listings contained in the BBS directories and TEXT directory on The Pier
  31. Shareware CD-ROM may be imported into a BBS data base for noncommercial
  32. use only.
  33.  
  34. 3.  Prohibited Use:
  35.  
  36. You may not rent or lease The Pier Shareware CD-ROM. You may not
  37. sublicense The Pier Shareware CD-ROM. You may not use The Pier Shareware
  38. CD-ROM on a public or private Bulletin Board System (BBS) in the
  39. Buffalo, N.Y. local phone calling area. All file listings contained in
  40. the BBSs directories, and the TEXT directory on The Pier Shareware
  41. CD-ROM are Copyrighted, and any commercial use is prohibited.

  43. 4.  Responsibility of Bulletin Board Systems:
  44.  
  45. File(s) that are found to be commercial or hacked programs by the System
  46. Operator, or as reported to you by the distributor of the CD-ROM, or by
  47. the Author of the program(s) in question, you must remove the file(s)
  48. name and description from the TEXT, or BBS directory upon receiving such
  49. knowledge of there existence.
  50.  
  51. The Pier Exchange reserves the right to terminate this License if there
  52. is a violation of its terms or default by the License Holder of this
  53. Agreement. Upon termination for any reason, all copies of the software
  54. must be returned to The Pier Exchange unless instructed to destroy the
  55. CD-ROM by The Pier Exchange, in either case the Licensed Holder will be
  56. liable for any and all damages suffered as a result or default.
  57.  
  58. The Author of The Pier Shareware CD-ROM and THEPIER.EXE software are not
  59. liable for damages suffered as a result of the improper use, proper use,
  60. or inability to use this software. This type of disclaimer is prohibited
  61. by law in some states, and therefore void in those states.
